✦ By commissioning me, Kisagi1317, in any kind of way, this automatically means you, the Commissioner, have read, understood, and agreed with my ◣Terms Of Service (TOS)◥, including future changes or modifications of such agreement.

▍By commissioning me (Kisagi1317, "the Artist") in any kind of way, this automatically means you ("the Commissioner") have read, understood, and agreed to the following Term of Service, including future changes or modifications of such agreement.【 GENERAL TERMS 】
✦ The purchase is for full-resolution digital files of the commissioned artwork ("the Artwork") in .png format only. This does not include the layered files, unless agreed upon in the Commission Agreement. No physical copies will be provided.
✦ The Artist reserves the rights of declining any commission order for any reason.
✦ All artwork and designs made by Kisagi1317 may never be used for any NFT activities or AI-related technology.
✦ The Commissioner and the Artist are not allowed to disclose each other's personal/contact details to any third parties without explicit consent from the other party.【 COPYRIGHT AGREEMENT: personal use 】
✦ I, the Artist, own the full rights and ownership to the artwork. Therefore, the Artist is allowed to use, display, and reproduce the Artwork for promotional or commercial purposes. This includes, but is not limited to, prints, merchandise, and online portfolios.
✦ The Commissioner may use the Artwork for personal use only (e.g. personal prints, page decoration, character profile pages, etc).
✦ The Commissioner may post the Artwork on social media platforms providing proper credits to the Artist.
✦ The Commissioner is not allowed to reproduce, distribute, or use the Artwork for commercial use (e.g. use for advertising, use in monetized platforms such as Twitch.tv and Youtube, sell merchandise of it, etc).
✦ The Commissioner is not allowed to edit the Artwork without explicit permission from the Artist (changing the background color or adding text is fine).
✦ If the Commissioner requests private artwork or does not allow the Artist to publicly display the Artwork, additional charges will apply. However, if the Artwork is intended as a birthday gift or for a reasonable duration, it will be free of charge. Please indicate this in the order form.【 COPYRIGHT AGREEMENT: commercial use 】
✦ Any usage for commercial, advertising, and/or promotional purposes is considered commercial use.
✦ The price tiers provided below are for reference only. Please contact the Artist to confirm the price again, as it may vary depending on the details of the work. Feel free to offer your budget, so that we can discuss the price further.
    ✧ [1.5x Price] Monetized platforms: Commissioners can use the Artwork in monetized platforms (e.g. Twitch.tv, Youtube, etc.) It is required to provide proper credit to the Artist.
    ✧ [2x Price] Commercial products (Small Businesses): The Commissioner can use the Artwork on monetized platforms and sell merchandise that features the Artwork in small businesses.
    ✧ [3x Price] Commercial products (Big Businesses): The Commissioner can use the Artwork on monetized platforms and sell a large quantity of merchandise featuring the Artwork.

【 ORDER PROCESS 】
✦ The Artist will contact the Commissioner once she is ready to start the commission.
✦ The Artist will provide a sketch for approval after receiving the payment.
✦ The Artist will provide updates with screenshots of the process only upon request from the Commissioner (for orders exceeding 50USD), or when the Artist requires confirmation on specific details.
✦ After the Artwork is completed:
    ✧ The Commissioner has right to reasonable amounts of minor changes, free of charge (e.g. color adjustment, small marking mistakes, etc).
    ✧ If the Commissioner wish to request a significant changes, the Artist may or may not accept the request. If the Artist accepts the request, additional charge may required.
✦ Upon delivery of the Artwork, it is the Commissioner's responsibility to store it properly. The Artist will not be responsible for loss of the Artwork once it has been sent. The Artist can not guarantee that the original copy of the product will be available in the case that the Commissioner lost their files.【 PAYMENT 】
✦ The Artist accepts payment via PayPal invoice (USD) or Thai banking (THB) only.
✦ Any payment made before the Artist accepts the Commissioner's order will be considered a donation.
✦ If payment is not made in a timely manner, the commission may be cancelled on the spot. 36 hours is what the Artist usually consider as a timely manner.【 WORK SPEED & DEADLINES 】
✦ Normally, the time for a commission to be completed is within a month.
    ✧ The Artist will inform the Commissioner if something comes up and there is a delay with the Artwork.
✦ If the Commissioner need their commission to be finished by a certain date, please ask the Artist first. Deadlines need to be reasonable.
    ✧ If faster completion or tight deadlines are required, the Artist may charge additional fees. The details of any rush orders and the corresponding charges will be discussed and agreed upon by both parties.【 CANCELLATIONS & REFUNDS 】
✦ If money has not been sent yet, the Commissioner has the right to cancel the commission.
✦ No refunds are allowed.
    ✧ Customer can only ask for a refund on orders with no progress for more than 5 months. Incomplete Artwork may not be edited or worked upon by any artist other than Kisagi1317
✦ The Artist will not be held responsible for late delivery caused by the Commissioner's failure to communicate in a timely manner. If there is no communication for a period of 4 weeks, it will be considered a cancellation without a refund.


※ Any statement can be bound to change if discussed with me, the Artist, prior to the commission.
